FOOTBALLSOCIETY USER AGREEMENT

Version 1.0 — Last updated 16-9-2026

Effective date 16-9-2026

Chapter 1 — General

This user agreement sets out the arrangements between FootballSociety and the user regarding the use of the FootballSociety platform, including the website, application, account features, community and other services offered by FootballSociety.

By creating an account and/or using FootballSociety, the user declares that they have read and agree to this user agreement.

The user agreement applies to every user who creates an account or otherwise uses features that require an account.

In addition to this user agreement, the General Terms and Conditions, the Privacy Policy and the Cookie Policy of FootballSociety may also apply. Together these documents form the basis for the use of FootballSociety as a platform.

When a user uses the Marketplace, specific terms for buying and selling products may additionally apply. These rules on their use are set out in the General Terms and Conditions.

FootballSociety reserves the right to further develop and adjust the platform, features and services.

FootballSociety offers a digital platform on which users can, among other things, display football shirts, present collections, share content and communicate with other users. Additional Marketplace terms apply to buying and selling products via the Marketplace.

Where provisions of this user agreement and the General Terms and Conditions directly conflict, the provisions specifically relating to the transaction in question apply for transactions and consumer rights, insofar as permitted by law. The Privacy Policy and Cookie Policy separately govern the processing of personal data and the use of cookies. Both are published on the platform.

A clear order of precedence:

  • •mandatory law;
  • •specific terms for a particular feature;
  • •Marketplace terms for Marketplace matters;
  • •this User Agreement for general platform use.

Chapter 2 — Definitions

In this user agreement the following terms have the meaning set out below:

  • •FootballSociety: the enterprise that operates and makes the FootballSociety platform available.
  • •Platform: the website, application and other digital environments of FootballSociety.
  • •User: any natural person who has created an account or uses the Platform.
  • •Account: the personal account through which a user gains access to FootballSociety features.
  • •Profile: the personal space of a user on FootballSociety.
  • •User Content: all information, photos, videos, texts, listings, replies, messages, stories and other content posted by a user on the Platform.
  • •Community: the social environment of FootballSociety in which users can share content and communicate with each other.
  • •Marketplace: the part of FootballSociety on which users can offer, buy and sell products.
  • •User Agreement: this agreement between FootballSociety and the user.

Chapter 3 — Access to the platform

FootballSociety provides users with access to the Platform insofar as they comply with the conditions of this user agreement and the General Terms and Conditions.

Certain features may only be available to users with a registered account.

FootballSociety aims to keep the platform functioning well, safely and accessibly. However, FootballSociety cannot guarantee that the Platform is always fully available.

Access may be temporarily restricted due to:

  • •maintenance;
  • •technical problems;
  • •security incidents;
  • •updates;
  • •outages;
  • •force majeure;
  • •necessary adjustments to the Platform;
  • •breach of the user agreement / general terms and conditions.

FootballSociety may change, expand, restrict or remove certain features when this is necessary or desirable for the development of the Platform.

FootballSociety offers users access to an online platform for offering, buying and selling football shirts and for sharing and discovering football-related content. FootballSociety may offer additional features and services, including features relating to payments, shipping, tracking, verification, buyer protection and dispute resolution. The terms under which these services are offered are included in the applicable General Terms and Conditions of FootballSociety.

Chapter 4 — Account and registration

To use certain features of FootballSociety the user must create an account.

Upon registration the user must provide correct, current and complete information.

A user may not:

  • •use a false identity;
  • •use another person's account;
  • •provide misleading information;
  • •create an account in order to impersonate another person or organisation.

Each user may in principle have only one personal account, unless FootballSociety gives prior permission for multiple accounts.

FootballSociety may request additional information when this is necessary for the security of the Platform, carrying out transactions or preventing fraud.

The user is responsible for keeping their account details up to date.

The user is responsible for providing correct, complete and current details when creating and using a FootballSociety account. If details change, the user must update them as soon as possible. Certain account details can be changed by the user via the account. FootballSociety may require additional verification for certain changes when this is necessary to safeguard account security or to prevent abuse, fraud or identity fraud.

The user is themselves responsible for keeping their login details and password confidential and must handle these details carefully. If a user forgets their password, they can use the available password recovery procedure. FootballSociety will not provide the existing password to the user. Where there is reason to doubt the user's identity or the security of the account, FootballSociety may require additional verification before access to the account is restored.

If a user suspects that their account has been hacked, abused or used by a third party without permission, they must inform FootballSociety as soon as possible. In such a case FootballSociety may take appropriate measures to protect the account and other users, including temporarily blocking or restricting access to the account. After sufficient verification, access to the account can be restored.

FootballSociety may require additional verification of a user's identity when this is reasonably necessary for the security of the platform, preventing or investigating fraud or identity abuse, restoring a possibly compromised account, protecting users or complying with legal obligations. In such cases FootballSociety may, if necessary and proportionate, request additional data or proof of identity. The user will be informed of the purpose of the verification. The processing of personal data and any identity documents takes place in accordance with FootballSociety's Privacy Policy.

If a user does not provide the requested data or verification, or where provided data cannot be sufficiently verified, FootballSociety may temporarily restrict access to certain features or temporarily suspend the account. Where a justified reason exists, FootballSociety may terminate the account. The measures taken must be proportionate to the reason for the verification or restriction.

A FootballSociety account is personal. When a user creates an account, a personal relationship arises between the user and FootballSociety. The account is intended to make one person identifiable and responsible for the activities carried out from that account. This is important for the reliability and safety of the community and the Marketplace.

FootballSociety wants users to be able to trust that a profile actually belongs to the person using it. This applies not only to buying and selling football shirts, but also to, for example, messages, reviews, bids, listings and other activities that can be linked to an account.

It is therefore not permitted to transfer, sell or rent an account to anyone else. It is also not intended for multiple people to structurally use one account. An account must be attributable to one responsible user.

These rules are important, among other reasons, because:

  • •security: FootballSociety must be able to establish which user is responsible for activities on the platform;
  • •reliability: other users must be able to trust that they are dealing with the person behind the profile;
  • •fraud prevention: sharing, selling or transferring accounts can make it difficult to investigate fraud, abuse or other violations;
  • •reviews and reputation: reviews, transactions and other account activities must relate to the actual user;
  • •Marketplace transactions: for a purchase or sale it must be clear with which user the other party is entering into an agreement;
  • •legal and administrative obligations: in certain situations FootballSociety may be obliged to be able to correctly link information about a user or transaction to the person concerned.

Responsibility therefore lies not only with FootballSociety. The user also has the responsibility to use their account carefully and to keep the associated details correct.

The user must provide correct and complete details upon registration and ensure that these details remain current during the use of FootballSociety. When, for example, an email address, name, address or other relevant information changes, the user must update these details in good time.

Keeping details current is particularly important when these details are used for communication, payments, shipping, verification or other parts of the FootballSociety services.

In short, the following principles apply to every FootballSociety account:

  • •the account is personal;
  • •the account may not be sold or transferred;
  • •the account may not be rented out or made available to others for payment;
  • •the account may not be structurally used jointly by multiple people;
  • •the user is responsible for the use of their account;
  • •login details may not be shared with others;
  • •the user provides correct details and keeps them current;
  • •the user may not pose as another person or enterprise.

Where FootballSociety has indications that an account is being shared, sold, rented, transferred or otherwise abused, FootballSociety may take appropriate measures. Depending on the situation this may mean, for example, that certain features are temporarily restricted, that additional verification is requested, or that the account is temporarily or permanently blocked.

These rules are not intended to unnecessarily restrict normal use of FootballSociety, but to ensure that every account has a clear and reliable identity and that users can safely participate in the FootballSociety community and Marketplace.

Chapter 5 — Age and legal capacity

When creating an account the user must provide correct information about their age.

A minimum age of 16 years applies to creating and using an account. A minimum age of 18 years applies to using the Marketplace.

Where a user is a minor, they must, insofar as legally required, have permission from a parent or legal representative to use the Platform and to enter into agreements. Furthermore, where the minimum age (18 years) is not met, the marketplace offered by FootballSociety may not be used.

FootballSociety may require additional age or identity verification when this is necessary for the security of the Platform, fraud prevention, payment processing or compliance with legal obligations.

Chapter 6 — Use of the platform

The Platform is intended to bring users together around football shirts, football culture, collecting, fashion, stories and the trade in permitted products.

Users may use the Platform for, among other things:

  • •presenting their football shirt collection;
  • •discovering other people's collections;
  • •sharing stories;
  • •posting photos and videos;
  • •following other users;
  • •communicating with other users;
  • •participating in the community.

The user must use the Platform in a normal, careful and lawful manner.

It is not permitted to use the Platform for activities that:

  • •are contrary to the law;
  • •are contrary to this agreement;
  • •may harm other users;
  • •may compromise the security of the Platform;
  • •may disrupt the operation of the Platform.

FootballSociety may only be used for lawful purposes that fit within the features of the Platform.

Chapter 7 — Profile and profile information

Each user can, depending on the available features, create a personal profile.

A user can, for example, add information about:

  • •name;
  • •username;
  • •favourite club;
  • •favourite player;
  • •football shirt collection;
  • •favourite shirts;
  • •interests;
  • •profile picture;
  • •personal description.

The user determines which information is added, insofar as FootballSociety offers this possibility.

The user may not post information that:

  • •is knowingly incorrect or misleading;
  • •infringes the rights of others;
  • •is discriminatory or threatening;
  • •is unlawful;
  • •is intended to mislead other users.

The user should be aware that certain profile information may be public.

A user may not use a username, profile picture or profile that reasonably gives the impression that the user represents FootballSociety, a football club, player, brand or other organisation.

Conduct rules and prohibited use

When using FootballSociety the user must behave respectfully and carefully. The platform may not be used for purposes that are contrary to the law, this User Agreement or the safety and interests of FootballSociety, other users or third parties.

It is not permitted to post unsolicited advertising, commercial expressions or self-promotion via FootballSociety outside the features designated by FootballSociety for that purpose. This includes repeatedly promoting one's own products, services, websites, social media accounts or other commercial activities. Commercial collaborations, sponsored content, affiliate promotion and other forms of paid or commercial promotion are only permitted when they have been approved in advance by FootballSociety and are clearly marked as commercial in the manner designated for that purpose.

Sharing external links is permitted when these are relevant to the content in question and are not contrary to the law, this User Agreement or the safety of users. It is not permitted to share links to harmful, fraudulent, misleading or otherwise inappropriate websites or services. This includes links used for phishing, fraud, spreading malware, spam or misleading users.

The user must respect the privacy of other users and third parties. It is not permitted to collect, publish, distribute or otherwise disclose personal data or other private data of others without a lawful basis or, where required, without consent. This includes, for example, addresses, telephone numbers, email addresses, financial data, login details and other information by which a person can be directly or indirectly identified. Disclosing private or identifying information with the aim or consequence of exposing, intimidating, harming or harassing a person, also known as doxxing, is not permitted.

It is not permitted to impersonate another person, organisation, football club, player or other party, or otherwise knowingly create a misleading impression about the identity, capacity or involvement of a person or organisation. Users may not use accounts, profiles or content in a way that may mislead others about the identity or authority of the user.

FootballSociety is intended as a safe and respectful community. It is therefore not permitted to repeatedly approach other users in an unwanted manner, to harass them, to intimidate them, to threaten them, or to keep seeking contact after it has been made clear that this is not desired. Spam, unwanted mass messages and structurally approaching users for commercial or other purposes without their consent are also not permitted. This applies to both public interactions and private messages and other communication features within the platform.

Posting, sharing or distributing pornographic or sexually explicit content is not permitted. Content that promotes, facilitates or depicts sexual exploitation, sexual intimidation, non-consensual sexual acts or sexual abuse is also prohibited.

Using FootballSociety to offer, promote or facilitate gambling or games of chance is not permitted. The same applies to offering, promoting, facilitating or organising illegal activities, including fraud, deception, money laundering, trade in prohibited goods and other activities contrary to applicable laws and regulations.

FootballSociety may remove, restrict or make inaccessible content that is contrary to these conduct rules. Depending on the nature, severity and frequency of the violation FootballSociety may additionally issue a warning, restrict certain features, temporarily suspend an account or terminate an account. Where this is necessary to protect users, FootballSociety or third parties, FootballSociety may take measures immediately without prior warning. Where there is a possibly criminal or otherwise unlawful activity, FootballSociety may report this to the competent authorities where this is legally permitted or required.

Conduct rules for interaction and communication

FootballSociety is intended as a safe and respectful community in which users can communicate with each other, share shirts and exchange stories. We therefore expect every user to treat other users with respect. Behaviour that intimidates, discriminates against, harasses or otherwise makes others feel unsafe is not permitted.

1. Harassment and intimidation

It is not permitted to harass, intimidate or unwantedly approach other users. This includes, among other things:

  • •repeatedly harassing another user after they have clearly indicated they do not want contact;
  • •sending repeated, unwanted or intimidating messages;
  • •stalking or structurally following, approaching or monitoring a user;
  • •threatening other users, both directly and indirectly;
  • •pressuring, intimidating or blackmailing other users;
  • •continuing to seek contact via other accounts after a user has ended or blocked contact.

A disagreement, discussion or negotiation about a purchase is permitted, but may not degenerate into intimidation, threats or personal attacks.

2. Hate speech and discrimination

FootballSociety does not accept hateful, discriminatory or dehumanising expressions. Users may not attack, insult or exclude others on the basis of, for example, origin, skin colour, nationality, gender, sexual orientation, disability, age or other personal characteristics.

It is, among other things, not permitted to:

  • •post discriminatory or hateful expressions;
  • •insult or dehumanise groups or persons on the basis of personal characteristics;
  • •encourage violence or hate against a group or person;
  • •distribute discriminatory images, symbols or other content.

Even where such expressions are intended as a "joke", "fan banter" or part of a football rivalry, they may be removed where they are contrary to these rules.

3. Doxxing and disclosure of private data

Users may not disclose, distribute or use private or personal data of other persons without consent. This also applies where this information is available elsewhere on the internet.

It is, among other things, not permitted, without consent, to:

  • •share residential addresses or other address details of persons;
  • •publish telephone numbers;
  • •disclose private email addresses or other contact details;
  • •publish private messages, documents or other personal information of others;
  • •share other data by which someone can be personally identified, approached or harassed without reasonable necessity.

Collecting or distributing such information with the aim of intimidating, threatening, harassing or exposing someone is particularly prohibited.

4. Impersonation and deception

Users may not impersonate someone else where this may lead to confusion or deception. This applies to other users, but also to football clubs, players, organisations and FootballSociety itself.

It is, among other things, not permitted to:

  • •pose as a professional footballer, former player or other public person;
  • •pose as a football club, association or other organisation;
  • •create an account or profile that wrongly gives the impression of being officially linked to a club, player or organisation;
  • •pose as FootballSociety, an employee or representative of FootballSociety;
  • •use logos, names, photos or other features in order to make others believe you are an official representative;
  • •intentionally mislead other users about your identity.

A username, profile or fan account that is clearly recognisable as a fan account is permitted as long as it does not create an incorrect impression of an official relationship.

5. Spam and unwanted commercial communication

FootballSociety is not a platform for the uncontrolled distribution of spam or commercial messages. Users may not abuse the communication and platform functions for massive or unwanted communication.

It is, among other things, not permitted to:

  • •send the same or similar messages to large numbers of users;
  • •send unsolicited commercial messages or offers to users;
  • •massively distribute links, advertisements or promotional content via private messages;
  • •repeatedly approach other users for commercial purposes without their request;
  • •use automated messages or accounts to spam users;
  • •use the messaging function for advertising, promotion or acquisition in a way that is contrary to FootballSociety's rules.

Normal communication between buyer and seller about a listing, order, payment or shipping is not spam, as long as this communication remains relevant to the transaction in question.

6. Enforcement

FootballSociety may remove content or communication that is contrary to these rules and take appropriate measures against users who violate these rules. Depending on the severity, frequency and circumstances of the violation, FootballSociety may, for example, issue a warning, remove content, restrict communication, temporarily suspend an account or permanently terminate an account.

In serious violations, including threats, stalking, doxxing, discrimination or intentional deception, FootballSociety may intervene immediately without prior warning.

Users can report suspected violations to FootballSociety. FootballSociety may investigate relevant information and, where necessary and legally permitted, take appropriate measures.

Chapter 8 — Community and interaction between users

FootballSociety has a community feature in which users can communicate with each other and share content.

FootballSociety expects users to treat each other with respect.

Users must:

  • •treat each other respectfully;
  • •not threaten other users;
  • •not harass other users;
  • •not post hateful content;
  • •not spread discrimination;
  • •not use intimidation;
  • •not spread spam;
  • •not intentionally mislead other users.

It is not permitted to use the community for commercial activities outside the Marketplace features intended for that purpose, unless FootballSociety has given permission.

FootballSociety may restrict content or accounts where this is necessary to protect the safety and quality of the community.

Chapter 9 — User content

User content and licence

Users can post, upload or otherwise make content available via FootballSociety, including photos, images, texts, stories, replies, profile information and other contributions (hereinafter: "User Content"). The user remains at all times the owner of the User Content they supply and retains all intellectual property rights attached to it. By making User Content available via FootballSociety, the user does not transfer ownership or intellectual property rights to FootballSociety.

To enable FootballSociety to offer the platform and its associated features, the user grants FootballSociety a non-exclusive, worldwide and royalty-free licence to use, reproduce, technically process, store, display and make available the User Content insofar as this is necessary for offering, maintaining, securing and improving the platform and the features used by the user. This licence is non-exclusive, meaning the user may continue to use their user content themselves and license it to third parties.

FootballSociety uses the User Content solely for the purposes for which it was made available via the platform and for the normal operation, security, maintenance and improvement of the relevant platform features. This licence does not give FootballSociety the right to sell User Content independently, license it to third parties or exploit it for other commercial purposes, unless the user has separately given permission for this or this is otherwise legally permitted.

When a user removes User Content, FootballSociety will no longer actively make that content available via the platform within a reasonable period. However, it may happen that the removed content temporarily remains available in technical systems, backups, caches or other systems necessary for the operation, security or continuity of the platform. Such technical copies are not used for new purposes and are deleted or overwritten in accordance with the applicable retention periods and technical processes of FootballSociety.

When a user terminates their account, certain User Content that is part of public interactions, discussions, transactions or other features of the platform may remain visible where removing it is not technically necessary, reasonably impossible or not desirable for the integrity of the platform. FootballSociety may, for example, keep such content anonymised or detached from the terminated account. Personal data are processed in accordance with the Privacy Policy.

FootballSociety may separately use User Content for marketing, promotion or communication outside the normal operation of the platform, such as on social media, in advertisements, newsletters or other marketing expressions, only where there is a separate lawful basis and, where required, the user has separately given prior permission for this. Granting the permission referred to above is not necessary to create an account or use the platform, unless this is necessary for a specific feature.

The user declares that they are entitled to make the User Content available via FootballSociety and that its use by FootballSociety in accordance with this User Agreement does not infringe the rights of third parties. The user remains responsible for the content they post on the platform themselves.

It is not permitted to post content that:

  • •is illegal;
  • •is discriminatory;
  • •is threatening;
  • •is insulting;
  • •is pornographic or sexually explicit;
  • •is violent;
  • •is misleading;
  • •is fraudulent;
  • •infringes intellectual property rights;
  • •unlawfully discloses personal data of others;
  • •contains malware or malicious software.

Chapter 10 — Prohibited use

It is prohibited to use the Platform for activities that are contrary to the law or this user agreement.

This includes, among other things:

  • •hacking;
  • •distributing malware;
  • •unauthorised access to systems;
  • •scraping without permission;
  • •automated collection of personal data;
  • •manipulating the Platform;
  • •bypassing security measures;
  • •creating fraudulent accounts;
  • •identity fraud;
  • •phishing;
  • •deception;
  • •spam;
  • •artificially influencing reviews;
  • •artificially inflating likes, followers or interactions;
  • •abuse of payment features.

It is also prohibited to use the Platform to harm other users or to damage FootballSociety.

Prohibited technical and improper use

It is not permitted to use FootballSociety in a way that may harm the operation, security, availability, integrity or infrastructure of the platform or that is aimed at obtaining unauthorised access to functions, data or systems. This includes, but is not limited to:

  • •performing reverse engineering, decompilation, disassembly or other attempts to discover the source code, technical operation or security mechanisms of FootballSociety;
  • •using bots, scrapers, crawlers, spiders or other automated systems to access the platform, collect data or perform actions, unless FootballSociety has expressly given permission for this;
  • •bypassing or manipulating technical limitations, security measures, access controls, rate limits or other protective mechanisms;
  • •performing automated or large-scale requests that may lead to overloading of the platform, servers, databases or other infrastructure;
  • •knowingly searching for, abusing, disclosing or exploiting bugs, vulnerabilities, errors or security leaks;
  • •attempting to gain access to accounts, data, systems or features for which the user has no permission;
  • •intercepting, modifying, manipulating or disrupting communication, transactions or data flows within FootballSociety;
  • •using technical means to artificially influence the operation, ranking, visibility, bids, advertisements, reviews or other functions of FootballSociety;
  • •creating or using multiple accounts in order to circumvent restrictions, sanctions, blocks or other measures of FootballSociety;
  • •selling, renting, lending, transferring or otherwise making an account available to another person;
  • •using another person's account or jointly using one account, unless FootballSociety expressly permits this;
  • •creating a new account after an existing account has been blocked, restricted, suspended or terminated in order to circumvent that measure;
  • •collecting, copying, storing, combining or using user information for external, commercial or other purposes without a valid basis and/or permission;
  • •collecting personal data of other users outside the features and purpose for which they are made available within FootballSociety;
  • •using data, content or features of FootballSociety to set up a competing service, database or platform without prior written permission;
  • •distributing malware, viruses, malicious code or other software that may affect the operation or security of FootballSociety or users;
  • •carrying out denial-of-service attacks, large-scale scraping or other activities that may disrupt the normal availability of FootballSociety.

Users may not perform actions that can reasonably be expected to negatively affect the continuity, security, performance or reliability of FootballSociety or the experience of other users.

If a user discovers a technical vulnerability or security problem, they must report it to FootballSociety as soon as possible and may not exploit the vulnerability for their own benefit or that of third parties.

FootballSociety reserves the right to take appropriate measures upon violation of these provisions, including removing content, restricting features, temporarily suspending or permanently blocking an account and, if necessary, taking further legal measures.

Chapter 11 — Reviews, ratings and reports

Where FootballSociety offers ratings or reviews, these must be based on an actual experience.

It is not permitted to:

  • •post fake reviews;
  • •buy reviews;
  • •pay others for positive reviews;
  • •knowingly review competitors negatively without grounds;
  • •artificially influence reviews.

Users can report content, listings or other users where they suspect a violation.

FootballSociety assesses reports on the basis of the available information.

FootballSociety may remove or restrict reviews where they are demonstrably not based on an actual experience, are contrary to the law or this agreement, contain personal data or were posted solely with the aim of harming a user or third party.

Removing or restricting a review is separate from a user's right to give a fair assessment of an actual experience.

Chapter 12 — Fraud, abuse and security

FootballSociety is committed to a safe, reliable and fair Platform. Users may not use the Platform in a way that endangers the safety, reliability or proper operation of FootballSociety or other users.

FootballSociety may take measures where it reasonably suspects that a user is abusing the Platform, committing fraud or acting contrary to this User Agreement. In doing so FootballSociety may, among other things, look at:

  • •creating or using false or misleading accounts;
  • •posing as another person, club, player or organisation;
  • •using stolen, incorrect or misleading account details;
  • •phishing, social engineering or other attempts to obtain user data;
  • •deceiving, misleading or harming other users;
  • •manipulating or abusing functions of the Platform;
  • •abusing promotions, campaigns or other benefits of FootballSociety;
  • •manipulating reviews, replies, statistics or other forms of user interaction;
  • •using bots, scripts or other automated means without permission;
  • •attempts to bypass security measures, account blocks or other technical restrictions;
  • •exploiting bugs, vulnerabilities or other technical errors;
  • •unusual activity that may indicate abuse, fraud or a security risk.

Users are obliged to protect their account details carefully and to inform FootballSociety as soon as possible where they suspect their account is being used without authorisation or there is a security incident.

Where FootballSociety has a reasonable suspicion of fraud, abuse or a security risk, it may take appropriate and proportionate measures. Depending on the nature and severity of the situation these measures may include, among other things:

  • •issuing a warning;
  • •removing or restricting content;
  • •restricting certain features;
  • •temporarily restricting or blocking the account;
  • •permanently terminating the account;
  • •taking additional technical or organisational measures to prevent further damage or abuse.

FootballSociety may, insofar as legally permitted and necessary, use and retain information to investigate, prevent and address fraud, abuse and security incidents.

These measures are without prejudice to other rights of FootballSociety under this User Agreement or applicable legislation.

Chapter 13 — Moderation and control

FootballSociety may moderate content and activities on the Platform to protect the safety and quality of the community.

Moderation may take place in response to:

  • •automated signals;
  • •user reports;
  • •checks;
  • •complaints;
  • •suspected violations.

FootballSociety may:

  • •remove;
  • •hide;
  • •restrict;
  • •adjust where technically necessary;
  • •temporarily take offline;

content.

Where a user believes that content has been wrongly removed or that an account has been wrongly restricted, the user can request FootballSociety to review the decision.

In its assessment FootballSociety may take into account the nature of the violation, the available information, previous violations and the possible consequences for other users or the Platform.

FootballSociety is not obliged to restore content where this is contrary to the law, this agreement or the safety of the Platform.

Where a violation is so serious, FootballSociety is not obliged to issue a warning and content may be removed immediately. Removing content does not mean that FootballSociety establishes that the content is unlawful.

Why FootballSociety moderates

FootballSociety may moderate user content and the use of the Platform to maintain a safe, reliable and pleasant environment for users. Moderation may, among other things, take place with a view to:

  • •the safety of users and the Platform;
  • •compliance with this User Agreement and other applicable rules;
  • •protecting users against harmful, misleading or unwanted behaviour;
  • •protecting the operation, integrity and reputation of FootballSociety;
  • •complying with legal and other applicable obligations;
  • •preventing and combating fraud, abuse and other forms of unwanted use.

FootballSociety is not obliged to check, assess or approve all user content prior to posting. The absence of prior checks does not mean that content or behaviour is permitted or approved by FootballSociety.

Where FootballSociety becomes aware of content or behaviour that appears to be contrary to this User Agreement, the law or the safety of the Platform or other users, FootballSociety may, depending on the circumstances, take appropriate measures.

Chapter 14 — Suspension and blocking

FootballSociety may temporarily restrict or block an account where there is a reasonable ground.

This may, for example, happen when a user:

  • •breaches this user agreement;
  • •breaches the General Terms and Conditions;
  • •threatens other users;
  • •abuses the Platform;
  • •causes security risks;
  • •uses multiple fraudulent accounts.

Depending on the severity of the situation FootballSociety may first issue a warning.

In serious cases FootballSociety may block an account without prior warning.

Measures for violations

Where a user breaches this User Agreement, the applicable General Terms and Conditions, the Marketplace rules or other rules that apply to the use of FootballSociety, FootballSociety may take appropriate measures depending on the nature, severity and frequency of the violation. In doing so FootballSociety may, among other things, issue a warning, temporarily restrict certain features, temporarily block the account or permanently block or terminate the account. In determining an appropriate measure FootballSociety may, among other things, take into account the severity of the violation, the consequences for other users or third parties, previous violations and the extent to which the user has remedied the violation.

A warning may be given for less serious or first violations, giving the user the opportunity to adjust their behaviour or content. For repeated violations, serious violations or where there is a risk to the safety of the platform or other users, FootballSociety may, without prior warning, proceed to a temporary restriction, temporary blocking or permanent blocking or termination of the account. Serious violations may include, among other things, fraud, identity abuse, threats, doxxing, serious intimidation, distributing malicious software, illegal activities or other conduct that may cause significant damage or risks.

A temporary restriction may mean that a user cannot or only limitedly use certain features of FootballSociety. With a temporary block, access to the account is wholly or partly blocked for a certain period. With a permanent block or termination, access to the account is permanently terminated. FootballSociety may additionally remove, adjust or make inaccessible content that is contrary to the applicable rules.

Where FootballSociety takes a measure against a user or user content, the user may, insofar as applicable, object to this decision. FootballSociety will, where reasonably possible, state how and within what period an objection can be made.

An objection can be submitted via the contact option or objection procedure designated by FootballSociety. The user must provide sufficient information to enable FootballSociety to assess the objection. The user may, among other things, explain why the measure taken is, in their opinion, incorrect, unjustified or disproportionate and, if relevant, provide additional information or evidence.

FootballSociety may reassess the objection and may, depending on the circumstances, uphold, adjust or revoke the original decision. Submitting an objection does not guarantee that a measure will be changed.

Submitting an objection does not automatically suspend an imposed measure. FootballSociety may maintain a block, restriction or other measure during the handling of the objection where it considers this necessary or appropriate, for example for reasons of safety, fraud, abuse or legal obligations.

FootballSociety may inform the user of the outcome of the objection and any further steps, insofar as this is reasonably possible and legally permitted.

A restriction, blocking or termination of an account does not automatically mean that existing rights and obligations from already concluded transactions lapse. Insofar as an account measure has consequences for an ongoing Marketplace transaction, action is taken in accordance with the applicable provisions in the Marketplace General Terms and Conditions. FootballSociety may, where this is necessary to protect users or to prevent fraud, temporarily suspend or block an ongoing transaction.

Where amounts still have to be paid out to a user at the time of an account measure, FootballSociety may temporarily suspend the payout where there is a reasonable ground, for example due to an ongoing dispute, a suspicion of fraud, a possible chargeback or a legal obligation. Once the reason for the suspension has been removed and payout is lawful and responsible, the remaining amount is paid out in accordance with the applicable terms.

User content posted by a user may, after a temporary or permanent block, be removed or made inaccessible where this content is contrary to the applicable rules. Content that forms part of public interactions, transactions or other features may, if necessary for the integrity of the platform, remain or be anonymised, in accordance with the provisions on User Content and the Privacy Policy.

Chapter 15 — Termination of the account

The user may terminate the account at any time, subject to ongoing obligations.

FootballSociety may terminate an account when:

  • •the user seriously or repeatedly breaches the agreement;
  • •there is fraud;
  • •there are illegal activities;
  • •the security of the Platform is threatened;
  • •the user seriously harms others;
  • •this is necessary due to legal obligations.

After termination the user can no longer use the relevant account features.

The user can delete their FootballSociety account at any time via the available feature or by submitting a deletion request to FootballSociety. Deleting an account does not mean that already arisen rights and obligations automatically lapse.

If transactions are still ongoing at the time of termination, the rights and obligations arising from these transactions continue until they are properly completed. Termination of an account therefore cannot lead to a user avoiding existing obligations from an already concluded transaction.

Termination of an account does not affect obligations that were validly arisen before termination. The Marketplace terms apply to Marketplace transactions.

Disputes that arose before the termination of the account may be continued after termination and handled in accordance with the applicable procedures. Deleting an account has no effect on the rights and obligations related to such a dispute.

FootballSociety may retain certain data and information after termination of the account where this is necessary to comply with a legal obligation, to record transactions, to prevent or investigate fraud, to handle disputes, to enforce the agreement or to serve a legitimate interest. The processing and retention periods of personal data are further described in the Privacy Policy.

Provisions that by their nature are intended to remain in force after termination of the account remain applicable after termination. This includes, among other things, provisions on outstanding obligations, liability, intellectual property rights, user content, disputes and applicable law. Termination of the account leaves these provisions unaffected.

Chapter 16 — Responsibility of the user

The user is responsible for:

  • •their own account;
  • •the correctness of provided information;
  • •posted User Content;
  • •compliance with laws and regulations;
  • •compliance with this agreement;
  • •compliance with the General Terms and Conditions.

The user must inform FootballSociety immediately in the event of unauthorised use of the account or a security problem.

Chapter 17 — Liability of FootballSociety

FootballSociety aims for a safe and reliable Platform, but cannot guarantee that the Platform is always available without errors, outages or interruptions.

FootballSociety is not responsible for content posted by users, unless FootballSociety is responsible for it under the law.

FootballSociety is also not automatically a party to agreements between buyers and sellers.

Insofar as permitted by law, FootballSociety is not liable for damage arising from:

  • •actions of other users;
  • •incorrect information from users;
  • •temporary unavailability of the Platform;
  • •use of external services;
  • •availability of the Platform;
  • •content of users;
  • •behaviour of users;
  • •external services;
  • •technical problems.

These provisions are without prejudice to statutory rights of consumers and other mandatory provisions.

None of the provisions in this user agreement is intended to exclude or restrict statutory rights of consumers where such restriction is not legally permitted.

FootballSociety remains liable for damage insofar as this liability cannot be excluded or limited under mandatory law.

Chapter 18 — Intellectual property

All intellectual property rights relating to the Platform, including the software, house style, logos, texts, design, features and other content developed by FootballSociety, remain with FootballSociety or its licensors.

It is not permitted, without prior permission, to:

  • •copy content of FootballSociety;
  • •use the logo;
  • •adopt the house style;
  • •copy software;
  • •reproduce parts of the Platform;
  • •make commercial copies of the Platform.

This does not apply to content posted by users themselves on the Platform.

Technical and commercial misuse

Users are not permitted, without prior written permission from FootballSociety, to:

  • •reverse engineer, decompile, disassemble or otherwise investigate the operation, source code, structure, security or technical operation of the Platform or parts thereof with the aim of reproducing or discovering it;
  • •copy, reproduce, collect or otherwise take over databases, datasets, user information, content collections or other data of FootballSociety in whole or in part;
  • •commercially reuse, exploit, distribute or make available data, features, content or other parts of the Platform outside the Platform;
  • •frame, mirror or otherwise technically reproduce the Platform or parts thereof within another website, application or service;
  • •use scraping, crawling, bots, spiders, scripts or other automated means to collect data or content from the Platform, unless FootballSociety has expressly given permission for this;
  • •circumvent or evade technical measures or restrictions that FootballSociety has put in place to prevent such use.

This prohibition does not apply insofar as a particular action is expressly permitted under mandatory applicable law. Users may use the Platform only for the purposes and in the manner for which FootballSociety makes it available.

Chapter 19 — Privacy and personal data

When using FootballSociety personal data are processed.

FootballSociety processes these personal data in accordance with its Privacy Policy and applicable privacy legislation.

The Privacy Policy explains, among other things:

  • •which personal data are processed;
  • •why they are processed;
  • •on what legal basis;
  • •with which parties data are shared;
  • •how long data are retained;
  • •what privacy rights users have.

By using the Platform the user is informed about this processing as described in the Privacy Policy.

The Privacy Policy forms a separate document and describes how FootballSociety processes personal data. The Privacy Policy does not form part of this user agreement insofar as it separately regulates privacy rights and obligations.

Chapter 20 — Cookies and similar techniques

FootballSociety may use cookies and similar techniques.

These may be necessary for:

  • •the functioning of the Platform;
  • •security;
  • •preferences;
  • •analyses;
  • •statistics;
  • •personalisation;
  • •marketing.

More information about this is included in the Cookie Policy of FootballSociety.

Where consent is required for certain cookies, FootballSociety will request this consent in the legally required manner.

Chapter 21 — External services and links

FootballSociety may use external services and links to third-party websites.

Examples of these are:

  • •payment providers;
  • •carriers;
  • •social media platforms;
  • •external websites;
  • •cloud providers;
  • •other digital services.

When using such services the user may be subject to the terms and privacy rules of the relevant third party.

FootballSociety is not responsible for the content, availability or operation of external websites, insofar as the law does not provide otherwise.

Chapter 22 — Reports and complaints

Users can report violations of this user agreement to FootballSociety.

A report may, for example, relate to:

  • •inappropriate content;
  • •fraud;
  • •counterfeit products;
  • •threats;
  • •discrimination;
  • •spam;
  • •abuse;
  • •suspicious listings.

FootballSociety assesses reports on the basis of the available information.

Users can contact for questions and complaints via:

  • •Email: team.footballsociety@outlook.com

FootballSociety may request additional information to properly assess a report.

Users can submit questions, complaints and reports via the contact channel indicated by FootballSociety. FootballSociety aims to handle reports within a reasonable period.

For complaints about a specific transaction FootballSociety may ask for the relevant order number, transaction number or other information to identify the transaction.

Chapter 23 — Amendment of the user agreement

FootballSociety may amend this user agreement where this is necessary.

This may, for example, be due to:

  • •changes in legislation;
  • •new features;
  • •changes to the Platform;
  • •new services;
  • •security measures;
  • •changes in business operations.

For important changes FootballSociety will inform users in an appropriate manner.

The most recent version of the user agreement is made available on the Platform.

Where a user continues to use the Platform after changes take effect, this constitutes agreement to the amended agreement, insofar as this is legally permitted and the user has been sufficiently informed of the change in advance.

Where an amendment has material consequences for the rights or obligations of users, FootballSociety will inform users in advance insofar as this is legally required.

Chapter 24 — Transfer of rights and obligations

The user may not transfer rights and obligations under this user agreement to another person without prior permission from FootballSociety.

FootballSociety may transfer its rights and obligations under this agreement to another enterprise where this is, for example, necessary due to:

  • •a reorganisation;
  • •merger;
  • •acquisition;
  • •sale of activities;
  • •transfer of the Platform.

Users' rights are not restricted by this.

Chapter 25 — Applicable law and disputes

Dutch law applies to this user agreement, unless mandatory law provides otherwise.

Disputes are first attempted to be resolved by mutual consultation between FootballSociety and the user.

Where a dispute cannot be resolved by mutual consultation, the dispute may be submitted to the competent court in accordance with the statutory rules.

For consumers the statutory rules regarding competent courts and consumer protection apply.

Chapter 26 — Final provisions

Where one or more provisions of this user agreement prove to be invalid or unenforceable, the remaining provisions remain fully in force.

In that case FootballSociety will try to replace the relevant provision with a valid provision that matches the original purpose as closely as possible.

Where this user agreement refers to other documents, such as the General Terms and Conditions, the Privacy Policy or the Cookie Policy, these documents form part of the broader legal framework for the use of FootballSociety.

The user remains responsible for complying with the rules applicable on the Platform.

This user agreement takes effect on 16-9-2026.
